Consent Order

A discipline committee of the Real Estate Council of British Columbia (the "Council") accepted the Consent Order Proposal submitted by Nadine Mary Westgate, and found that Ms. Westgate committed professional misconduct between June 2015 and April 2016, in or about November 2016, and in or about June 2017, when she:

1. permitted an unlicensed branch office of the brokerage to operate, in that signage was displayed, advertising material for the brokerage included reference to the branch and associated licensees had access to the branch, contrary to the RESA; and
2. failed to ensure that the business of the brokerage was carried out competently and in accordance with the Real Estate Services Act and the Regulations, Rules and/or Bylaws; and
3. failed to ensure that written notice was promptly provided to the seller that the deposit due under the contract for the purchase of property was not received, contrary to the Rules,
4. as set out in her Consent Order Proposal.

Results

A discipline committee of the Council has ordered, and Ms. Westgate has agreed to, the following penalties:

1. a reprimand;
2. a discipline penalty of $10,000;
3. enforcement expenses of $1,500; and
4. successful completion of the Broker's Remedial Course; and
5. an audit of the brokerage at her own expense by June 30, 2020.
